# **Условия использования**

Условия использования платформы Lovd для обмена фото.

Это краткое изложение, которое должно тебе помочь. Английская версия ниже является полным юридически обязывающим текстом в той мере, в какой это допускает закон.

## **Краткое изложение**

### **Кто может пользоваться Lovd**

Тебе должно быть не меньше 16 лет. При регистрации нужно указывать правдивые данные и беречь свои данные для входа, а за всё, что происходит в твоём аккаунте, отвечаешь ты.

### **Цена и оплата**

- **Explorer** бесплатный, с 500 МБ места. **Curator** стоит 1 € в месяц или 8 € в год за 5 ГБ. **Archivist** стоит 3 € в месяц или 30 € в год за 50 ГБ.
- Цены указаны в евро. В Великобритании и ЕС они включают НДС; в других странах возможные налоги показываются при оформлении заказа, до оплаты.
- Платежи обрабатывает Polar, наш официальный продавец (merchant of record). Оформляя подписку, ты также принимаешь условия Polar.
- Подписка оплачивается заранее, помесячно или за год, в зависимости от выбранного периода.
- Подписка автоматически продлевается в конце каждого расчётного периода, пока ты её не отменишь.
- Деньги за неполный расчётный период не возвращаются. Мы можем изменить цены, предупредив об этом за 30 дней.

### **Отмена и 90 дней доступа только для чтения**

Отменить подписку можно в любой момент. Доступ сохраняется до конца расчётного периода. После этого у тебя есть 90 дней доступа только для чтения: ты можешь просматривать и скачивать все свои фото и коллекции, но не можешь загружать ничего нового. До конца этих 90 дней мы присылаем напоминания по email и предоставляем полный экспорт твоих материалов. В любой момент в течение 90 дней ты можешь снова оформить подписку и вернуть полный доступ. Иначе твои материалы будут удалены после последнего уведомления.

### **Закрытие аккаунта**

Удалить аккаунт можно в настройках аккаунта или написав нам. После этого у тебя есть 7 дней, чтобы передумать; за это время ничего не удаляется. Затем твои материалы, профиль и аккаунт окончательно удаляются из наших рабочих систем, а резервные копии очищаются в течение 90 дней. Если у тебя есть активная подписка, она отменяется в момент удаления, и больше никаких списаний не будет. Деньги за уже оплаченный период не возвращаются. Это не затрагивает твоё законное право отказаться от новой подписки. Мы удаляем твои персональные данные из записей нашего платёжного провайдера, но счета и записи о платежах хранятся столько, сколько требует налоговое и бухгалтерское законодательство.

Мы тоже можем приостановить или закрыть твой аккаунт, например если ты нарушаешь эти условия или если аккаунтом не пользовались больше 12 месяцев (с предварительным уведомлением). После этого мы можем удалить твои материалы.

### **Твои материалы**

Твои фото остаются твоими. Ты даёшь нам ограниченную лицензию на хранение, резервное копирование, показ и обработку твоих материалов (например, для создания миниатюр), но только для того, чтобы предоставлять сервис. Лицензия прекращается, когда ты удаляешь материалы или закрываешь аккаунт. Ты отвечаешь за то, чтобы у тебя было право загружать и распространять то, что ты загружаешь, за уважение к частной жизни людей на фото и за собственные резервные копии.

### **Допустимое использование**

Нельзя загружать или распространять: материалы сексуальной эксплуатации детей (загрузки проверяются автоматически, а о нарушениях сообщается в компетентные органы), наготу или откровенно сексуальные материалы, насилие или шокирующие изображения, ненависть или дискриминацию, материалы, нарушающие чужие права, незаконные материалы, травлю или угрозы, а также вредоносные программы. Также нельзя создавать несколько аккаунтов, чтобы обойти ограничения, передавать другим свои данные для входа, пытаться получить доступ к чужим аккаунтам, собирать данные сервиса автоматическими средствами, нарушать работу платформы или перепродавать сервис без разрешения.

Если ты нарушишь эти правила, мы можем удалить материалы, вынести предупреждение, приостановить или закрыть аккаунт и сообщить о незаконных материалах. Обжаловать решение можно в течение 14 дней, написав на [**support@lovd.app**](mailto:support@lovd.app).

### **Пределы нашей ответственности**

Сервис предоставляется «как есть», без гарантий. В максимальной степени, допускаемой законом, мы не несём ответственности за косвенный или последующий ущерб и за потерю данных, а наша общая ответственность ограничена суммой, которую ты заплатил нам за 12 месяцев до предъявления претензии. Эти ограничения не действуют там, где их запрещает законодательство ЕС о защите прав потребителей. Как потребитель в ЕС ты сохраняешь все свои обязательные права.

### **Применимое право**

Эти условия регулируются правом Нидерландов. Потребители из ЕС могут обратиться в суд своей страны или в суд Нидерландов. Для всех остальных споры рассматривают суды Амстердама.

### **1. Introduction and Acceptance**

Welcome to lovd ("we," "our," "us," or the "Platform"). These Terms of Service ("Terms") govern your access to and use of our photo sharing and storage services.

By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, you may not use our services.

### **2. Eligibility**

#### **Age Requirement**

**You must be at least 16 years old to use Lovd.** By using lovd, you represent and warrant that you are at least 16 years of age. If we discover that a user is under 16, we will terminate their account and delete their data.

#### **Account Registration**

To use our services, you must provide accurate registration information, keep it up to date, maintain the security of your credentials, and accept responsibility for all activity under your account.

### **3. Our Services**

lovd is a platform for storing, organizing, and sharing photos with family and friends. This includes photo and image storage, collection creation and organization, and sharing and collaboration features.

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.

### **4. Subscription and Payment**

#### **Pricing**

We offer the following subscription tiers:

- **Explorer** (free): 500 MB storage
- **Curator**: €1/month or €8/year for 5 GB storage
- **Archivist**: €3/month or €30/year for 50 GB storage

Prices are in EUR. For customers in the UK and EU, prices include VAT. Elsewhere, any applicable taxes are shown at checkout before you pay, based on your location.

#### **Payment Processing**

Payments are processed by Polar.sh, our Merchant of Record. By subscribing, you also agree to Polar's terms of service. Polar handles payment processing, tax collection and remittance, invoicing, and subscription management.

#### **Billing and Cancellation**

- Subscriptions are billed monthly or annually in advance, depending on the billing period you choose
- Subscriptions renew automatically at the end of each billing period until you cancel
- You may cancel at any time; access continues until the end of your billing period
- No refunds are provided for partial billing periods
- If you close your account, your subscription is cancelled when the deletion takes effect (see Section 14)
- We may change pricing with 30 days' notice

#### **After Cancellation**

When your subscription ends, you receive a 90-day read-only grace period of viewing access.

During your grace period you can view and download all your photos and collections, but you cannot upload new content. Your memories remain safe and accessible.

Before your grace period ends, we send reminder emails and make a complete export of your content available for download. You may resubscribe at any time during the 90 days to restore full access.

If you do not resubscribe before the grace period ends, your content will be removed after a final notification. We do not retain content indefinitely after a grace period expires.

### **5. Acceptable Use Policy**

#### **Prohibited Content**

You may not upload, store, or share content that:

1. **Contains child sexual abuse material (CSAM).** We have zero tolerance for CSAM. Uploads are automatically scanned, and violations are reported to relevant authorities including the National Center for Missing & Exploited Children (NCMEC).
2. **Contains nudity or sexually explicit material.** Including pornography, sexual content, or intimate images shared without consent.
3. **Depicts violence or gore.** Including graphic violence, injury, torture, or content that glorifies violence.
4. **Promotes hate or discrimination.** Content targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
5. **Infringes intellectual property.** Content you do not have the right to share, including others' copyrighted material.
6. **Is illegal.** Content that violates any applicable law or regulation.
7. **Harasses or threatens others.** Including bullying, stalking, or intimidation.
8. **Contains malware or harmful code.** Files designed to damage or gain unauthorized access to systems.

#### **Prohibited Activities**

You may not:

- Create multiple accounts to circumvent restrictions
- Share account credentials with unauthorized users
- Attempt to access other users' accounts or data
- Use automated tools to scrape or access our services
- Interfere with the proper functioning of our platform
- Resell or commercially exploit our services without permission

### **6. Content Moderation and Enforcement**

#### **How We Moderate**

We use automated scanning for CSAM with industry-standard tools, user reporting mechanisms, manual review of flagged content, and proactive monitoring for policy violations.

#### **Consequences of Violations**

Depending on the severity of a violation, we may remove violating content, issue warnings, temporarily suspend or permanently terminate accounts, and report illegal content to law enforcement.

For CSAM violations, we immediately and permanently ban the account and report to authorities. There are no warnings for CSAM.

#### **Appeals**

If you believe your content was removed in error or your account was wrongly suspended, you may appeal by emailing [**support@lovd.app**](mailto:support@lovd.app) within 14 days. We will review and respond within 30 days.

### **7. Your Content**

#### **Ownership**

You retain all ownership rights to content you upload to Lovd. We do not claim ownership of your photos or other content.

#### **License to Us**

By uploading content, you grant us a limited license to store and back up your content, display it to you and users you've shared with, process it (e.g., generate thumbnails, optimize for display), and transfer it for service operation purposes. This license exists only to provide our services and ends when you delete your content or close your account.

#### **Your Responsibilities**

You are responsible for ensuring you have the right to upload and share content, respecting the privacy of individuals in your photos, obtaining necessary consents for photos of others, and maintaining your own backups of important content.

### **8. Privacy and Data Protection**

Our collection, use, and protection of your personal data is governed by our [**Privacy Policy**](https://www.lovd.app/ru/help/legal/privacy-policy), which complies with the General Data Protection Regulation (GDPR) and other applicable data protection laws. In short: we process your data to provide our services, we do not sell your personal data, you have rights to access, correct, and delete your data, and we implement appropriate security measures.

### **9. Intellectual Property**

#### **Our Property**

lovd, our logo, website design, and service features are our intellectual property. You may not copy, modify, or distribute them without permission.

#### **Copyright Complaints**

If you believe content on lovd infringes your copyright, contact us at [**support@lovd.app**](mailto:support@lovd.app) with: identification of the copyrighted work, the location of the infringing content, your contact information, a statement of good-faith belief, a statement of accuracy under penalty of perjury, and your signature.

### **10. Disclaimer of Warranties**

Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free service. We do not guarantee that our services will meet your requirements or that any content will be preserved indefinitely.

### **11. Limitation of Liability**

To the maximum extent permitted by applicable law:

- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not liable for data loss; you are responsible for maintaining backups

These limitations apply regardless of the legal theory and even if we were advised of the possibility of such damages.

**Note:** These limitations do not apply where prohibited by EU consumer protection law. If you are an EU consumer, you retain all mandatory rights under applicable law.

### **12. Indemnification**

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from your use of our services, your content, your violation of these Terms, or your violation of any third-party rights.

### **13. Changes to These Terms**

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website, emailing your registered address, and displaying a notice when you log in. Continued use of our services after changes take effect constitutes acceptance of the new Terms.

### **14. Termination**

#### **By You**

You may cancel your subscription or close your account at any time.

**Subscription cancellation:** You receive a 90-day read-only grace period of viewing access (see Section 4). Before it ends, we send reminders and a complete export of your content. If you do not resubscribe before the grace period ends, your content will be removed after a final notification.

**Account closure (deletion):** You may request full account deletion through your account settings or by contacting us. Upon closure, you have 7 days to change your mind, during which nothing is removed. After that your content, profile and account are permanently removed from our active systems, and backups are purged within 90 days. If you have an active subscription, it is cancelled when the deletion takes effect, and no further payments are taken. Closing your account does not entitle you to a refund for the rest of the billing period you have already paid for; this does not affect any right you have by law to withdraw from a new subscription. We remove your personal details from our payment provider's records, but invoices and transaction records are kept for as long as tax and accounting law requires.

#### **By Us**

We may suspend or terminate your account if you violate these Terms, engage in illegal activity, create risk or legal exposure for us, or keep an account inactive for more than 12 months (with prior notice).

#### **Effect of Termination**

Upon termination, your license to use our services ends, we may delete your content, and provisions that should survive (indemnification, limitation of liability, governing law) remain in effect.

### **15. Governing Law and Disputes**

#### **Governing Law**

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.

#### **Dispute Resolution**

We encourage you to contact us first to resolve any disputes informally. If we cannot:

- **EU consumers:** You may bring proceedings in the courts of your country of residence or the Netherlands
- **Others:** Disputes shall be resolved in the courts of Amsterdam, Netherlands

### **16. Digital Services Act Compliance**

In accordance with the EU Digital Services Act (DSA), we provide clear information about content moderation, offer accessible reporting and appeal mechanisms, publish transparency information about content removal, and designate a point of contact for authorities. ### **17. General Provisions**

- **Entire Agreement:** These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lovd.
- **Severability:** If any provision is found unenforceable, the remaining provisions continue in effect.
- **No Waiver:** Our failure to enforce any right does not waive our right to enforce it later.
- **Assignment:** You may not assign your rights under these Terms. We may assign our rights to a successor.
- **Language:** These Terms are provided in English. In case of any conflict with translations, the English version prevails.
