Acești Termeni și condiții guvernează accesul tău la și utilizarea serviciilor noastre de partajare și stocare a fotografiilor. Prin crearea unui cont sau utilizarea serviciilor noastre, ești de acord cu acești termeni.

Eligibilitate

• Trebuie să ai cel puțin 18 ani pentru a folosi lovd
• Trebuie să furnizezi informații de înregistrare corecte
• Ești responsabil pentru toate activitățile din contul tău

Serviciile noastre

lovd oferă o platformă pentru stocarea, organizarea și partajarea fotografiilor cu familia și prietenii, inclusiv:

• Stocarea fotografiilor și imaginilor
• Crearea și organizarea colecțiilor
• Funcționalități de partajare și colaborare

Abonament și plată

• Explorer (gratuit): 500 MB stocare
• Curator: €1/lună sau €8/an pentru 5 GB stocare
• Archivist: €3/lună sau €30/an pentru 50 GB stocare

Toate abonamentele sunt facturate anual în avans.

După anulare:

• Primești o perioadă de grație doar pentru citire de 90 de zile, cu acces de vizualizare.
• Înainte de încheierea perioadei de grație, trimitem mementouri și un export complet al conținutului tău.
• Te poți reabona oricând în timpul celor 90 de zile pentru a restabili accesul complet.
• Dacă nu reînnoiești abonamentul înainte de încheierea perioadei de grație, conținutul va fi eliminat după o notificare finală.

Conținut interzis

Nu poți încărca conținut care:

• Conține material de abuz sexual al copiilor (CSAM)
• Conține nuditate sau material sexual explicit
• Înfățișează violență sau gore
• Promovează ura sau discriminarea
• Încalcă proprietatea intelectuală
• Este ilegal

Dreptul tău de proprietate asupra conținutului

Păstrezi toate drepturile de proprietate asupra conținutului pe care îl încarci pe lovd. Nu revendicăm proprietatea asupra fotografiilor tale.

Limitarea responsabilității

Responsabilitatea noastră totală nu depășește suma pe care ai plătit-o în cele 12 luni anterioare reclamației.

Legea aplicabilă

Se aplică legea olandeză. Consumatorii din UE păstrează toate drepturile obligatorii conform legislației aplicabile.

1. Introduction and Acceptance

Welcome to lovd ("we," "our," "us," or the "Platform"). These Terms of Service ("Terms") govern your access to and use of our photo sharing and storage services.

By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, you may not use our services.

2. Eligibility

Age Requirement

You must be at least 18 years old to use lovd. By using lovd, you represent and warrant that you are at least 18 years of age. If we discover that a user is under 18, we will terminate their account and delete their data.

Account Registration

To use our services, you must provide accurate registration information, keep it up to date, maintain the security of your credentials, and accept responsibility for all activity under your account.

3. Our Services

lovd is a platform for storing, organizing, and sharing photos with family and friends. This includes photo and image storage, collection creation and organization, and sharing and collaboration features.

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.

4. Subscription and Payment

Pricing

We offer the following subscription tiers:

• Explorer (free): 500 MB storage
• Curator: €1/month or €8/year for 5 GB storage
• Archivist: €3/month or €30/year for 50 GB storage

Prices are in EUR. Applicable taxes (including VAT) are calculated and added at checkout based on your location.

Payment Processing

Payments are processed by Polar.sh, our Merchant of Record. By subscribing, you also agree to Polar's terms of service. Polar handles payment processing, tax collection and remittance, invoicing, and subscription management.

Billing and Cancellation

• Subscriptions are billed monthly or annually in advance, depending on the billing period you choose
• You may cancel at any time; access continues until the end of your billing period
• No refunds are provided for partial billing periods
• We may change pricing with 30 days' notice

After Cancellation

When your subscription ends, you receive a 90-day read-only grace period of viewing access.

During your grace period you can view and download all your photos and collections, but you cannot upload new content. Your memories remain safe and accessible.

Before your grace period ends, we send reminder emails and make a complete export of your content available for download. You may resubscribe at any time during the 90 days to restore full access.

If you do not resubscribe before the grace period ends, your content will be removed after a final notification. We do not retain content indefinitely after a grace period expires.

5. Acceptable Use Policy

Prohibited Content

You may not upload, store, or share content that:

1. Contains child sexual abuse material (CSAM), We have zero tolerance for CSAM. Uploads are automatically scanned, and violations are reported to relevant authorities including the National Center for Missing & Exploited Children (NCMEC).
2. Contains nudity or sexually explicit material, Including pornography, sexual content, or intimate images shared without consent.
3. Depicts violence or gore, Including graphic violence, injury, torture, or content that glorifies violence.
4. Promotes hate or discrimination, Content targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
5. Infringes intellectual property, Content you do not have the right to share, including others' copyrighted material.
6. Is illegal, Content that violates any applicable law or regulation.
7. Harasses or threatens others, Including bullying, stalking, or intimidation.
8. Contains malware or harmful code, Files designed to damage or gain unauthorized access to systems.

Prohibited Activities

You may not:

• Create multiple accounts to circumvent restrictions
• Share account credentials with unauthorized users
• Attempt to access other users' accounts or data
• Use automated tools to scrape or access our services
• Interfere with the proper functioning of our platform
• Resell or commercially exploit our services without permission

6. Content Moderation and Enforcement

How We Moderate

We use automated scanning for CSAM with industry-standard tools, user reporting mechanisms, manual review of flagged content, and proactive monitoring for policy violations.

Consequences of Violations

Depending on the severity of a violation, we may remove violating content, issue warnings, temporarily suspend or permanently terminate accounts, and report illegal content to law enforcement.

For CSAM violations, we immediately and permanently ban the account and report to authorities. There are no warnings for CSAM.

Appeals

If you believe your content was removed in error or your account was wrongly suspended, you may appeal by emailing support@lovd.app within 14 days. We will review and respond within 30 days.

7. Your Content

Ownership

You retain all ownership rights to content you upload to lovd. We do not claim ownership of your photos or other content.

License to Us

By uploading content, you grant us a limited license to store and back up your content, display it to you and users you've shared with, process it (e.g., generate thumbnails, optimize for display), and transfer it for service operation purposes. This license exists only to provide our services and ends when you delete your content or close your account.

Your Responsibilities

You are responsible for ensuring you have the right to upload and share content, respecting the privacy of individuals in your photos, obtaining necessary consents for photos of others, and maintaining your own backups of important content.

8. Privacy and Data Protection

Our collection, use, and protection of your personal data is governed by our Privacy Policy, which complies with the General Data Protection Regulation (GDPR) and other applicable data protection laws. In short: we process your data to provide our services, we do not sell your personal data, you have rights to access, correct, and delete your data, and we implement appropriate security measures.

9. Intellectual Property

Our Property

lovd, our logo, website design, and service features are our intellectual property. You may not copy, modify, or distribute them without permission.

Copyright Complaints

If you believe content on lovd infringes your copyright, contact us at support@lovd.app with: identification of the copyrighted work, the location of the infringing content, your contact information, a statement of good-faith belief, a statement of accuracy under penalty of perjury, and your signature.

10. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free service. We do not guarantee that our services will meet your requirements or that any content will be preserved indefinitely.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for data loss; you are responsible for maintaining backups

These limitations apply regardless of the legal theory and even if we were advised of the possibility of such damages.

Note: These limitations do not apply where prohibited by EU consumer protection law. If you are an EU consumer, you retain all mandatory rights under applicable law.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from your use of our services, your content, your violation of these Terms, or your violation of any third-party rights.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website, emailing your registered address, and displaying a notice when you log in. Continued use of our services after changes take effect constitutes acceptance of the new Terms.

14. Termination

By You

You may cancel your subscription or close your account at any time.

Subscription cancellation: You receive a 90-day read-only grace period of viewing access (see Section 4). Before it ends, we send reminders and a complete export of your content. If you do not resubscribe before the grace period ends, your content will be removed after a final notification.

Account closure (deletion): You may request full account deletion through your account settings or by contacting us. Upon closure, your access ends immediately, your content is deleted within 30 days, and some information may be retained as required by law.

By Us

We may suspend or terminate your account if you violate these Terms, engage in illegal activity, create risk or legal exposure for us, or keep an account inactive for more than 12 months (with prior notice).

Effect of Termination

Upon termination, your license to use our services ends, we may delete your content, and provisions that should survive (indemnification, limitation of liability, governing law) remain in effect.

15. Governing Law and Disputes

Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.

Dispute Resolution

We encourage you to contact us first to resolve any disputes informally. If we cannot:

• EU consumers: You may bring proceedings in the courts of your country of residence or the Netherlands
• Others: Disputes shall be resolved in the courts of Amsterdam, Netherlands

EU Online Dispute Resolution

If you are an EU consumer, you may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr

16. Digital Services Act Compliance

In accordance with the EU Digital Services Act (DSA), we provide clear information about content moderation, offer accessible reporting and appeal mechanisms, publish transparency information about content removal, and designate a point of contact for authorities. 17. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and lovd.
• Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
• No Waiver: Our failure to enforce any right does not waive our right to enforce it later.
• Assignment: You may not assign your rights under these Terms. We may assign our rights to a successor.
• Language: These Terms are provided in English. In case of any conflict with translations, the English version prevails.
